Special conditions:
The sale is made inclusive of all taxes, plus legal fees. In addition to the auction price, the following fees will be charged: 20% incl. VAT + 3.6% incl. VAT for live purchases or €48 per vehicle purchased live. Payment must be made in cash. Goods and equipment can only be collected once payment has been received in full. All costs of any nature whatsoever, and in particular handling or other costs associated with the ownership of the goods and equipment and their collection, shall be borne in full by the purchaser; The removal will be at the expense and under the sole responsibility of the successful bidder, who must therefore provide the equipment necessary for its smooth running (handling equipment, sufficient number of people, starter booster for vehicles, etc.). The successful bidder will also be solely responsible for any damage or disorder caused during removal. All assets must be removed by the deadline announced by the auctioneer, i.e. : At the latest on the 20th day following the sale, a storage fee of 5 euros per day of delay per lot may be charged if this date is exceeded. Lots that are to be collected from a location other than the Auction House must be collected from the Auction House at the address indicated in the special terms and conditions, at the times and address indicated. No other time slot than the one(s) specified in the special conditions will be granted. The buyer takes the goods and materials in the condition in which they are found, at their current place of storage and under their current customs regime. The sale will take place without any guarantee of any kind, in particular as regards description, quality, quantity (the highest or lowest price benefiting the successful bidder), size and capacity, except where stated in the minutes of the sale, which include the information given to the public at the time of the sale. As the information provided is only indicative, no claim will be accepted once the sale has been completed. Given his status, the auctioneer is an agent acting on behalf of the seller, and it is the seller of the taxed item who is solely responsible for declaring and paying VAT to the relevant tax authorities. The tax liability of the commissioned auctioneer, of the expert working alongside him or her, who draws up the invoice cannot be incurred unless he or she fails to report to his or her seller or makes erroneous or fraudulent statements on the report or invoice or any document in lieu thereof. Damages due to removal, appropriation by removing, decluttering or transporting, will be borne by the successful bidders. All water inlets must be blocked by plugs, and fuses must be installed following the dismantling of electrical equipment. The lot awarded will remain at the risk and peril of the successful bidders, as soon as the award has been made, even if it has not been delivered for any reason whatsoever, in particular while awaiting the correct method of payment. If the lots purchased contain waste or toxic products of any kind whatsoever, the buyer is advised that these must be destroyed in accordance with the laws and regulations in force. All disputes will be referred to the courts of Cherbourg.
