CONDITIONS OF JUDICIAL SALES Sold as is without guarantee. Collection by appointment - That the sale is expressly for cash. The sale costs are 14.28% VAT included in addition to the bidding. - That only the description counts and that the photos are only intended to illustrate the lot described. - Live fees: an additional 1.2% inclusive of tax for live inter-auction fees. - That judicial sales are made without guarantee (art 1649 of the Civil Code), that the weights and quantities indicated are only indicative and that the buyer is responsible for checking the goods at the exhibition. - That the transfer of ownership occurs as soon as the auction is pronounced, that the lots are at the buyer's risk from the time of the auction, and that the buyer must remove them immediately. If this is not the case, the successful bidder undertakes to destroy the said machines if they are not fitted with sufficient safety devices or if he does not intend to bring them into conformity for normal use for their usual purpose. The auctioneer is therefore released from any after-sales control, exonerating him from any liability. - That the auctioneer will assess cases of wild bidding and authorise resale without observing any formalities. Any auction will be cancelled automatically if the price and costs are not paid in cash, and a resale will be carried out immediately on the basis of an irresponsible bid, at the risk and peril of the defaulting buyer, who will be required to pay the difference. - In the case of payment by cheque, if the funds are insufficient, and if the issuer does not respond to the formal notice within the period prescribed by law and completes the funds, the unpaid item will be resold at the first useful auction. - That, in addition to the auction price, the buyer will have to pay 11.90% exclusive of tax selling costs and an additional 1% for live costs via inter-bidding. - That the sale has been advertised in newspapers and on Interenchères. - Storage costs proportional to the value of the equipment will be invoiced at the end of the auction if the lots sold are not collected immediately. The successful bidder must leave the lots where they are at the end of the sale. - Lots not collected by the successful bidder on the days stipulated for collection will be deemed to have been abandoned on the premises, with the hammer price remaining payable in full. - That all bids, even online, will be considered as an irrevocable commitment to purchase. - That a deposit may be requested to guarantee purchases. The deposit will be deducted from the bill of sale. In the event of default by the successful bidder, the deposit will be retained. The amount of the deposit will be debited from the bank card pre-registered on interenchères on the evening of the sale. - Lots may be deemed to have been abandoned on the premises if the successful bidder fails to collect his purchases on the days indicated for collection. The auction house reserves the right to charge a fixed fee of €600 (incl. VAT) to compensate the buyer for making a new appointment. Collection conditions : The days and times of collection will be determined by the auction house after the sale. The dates and times for collection will be determined by the auction house according to the nature of the lots, their size and volume. The dates will be communicated and proposed to the buyers after the sale. For removals requiring extensive dismantling, specific deadlines and conditions will be agreed on a case-by-case basis between the Buyers and the Auctioneers' Office and the Judicial Representative in charge of the case. The delivery of the slip will mention the conditions of good completion of the removal before its intervention and the purchaser will entrust a cheque of guarantee signed in guarantee of the good completion of its removal. Removal must be carried out within the agreed timeframe and with due respect for the premises, failing which the purchaser will be held liable and the deposit cheque will be cashed in respect of any damage caused. Dismantling, handling and transport are the responsibility of the purchaser. The purchaser is also responsible for any third parties who may assist with removal. The purchaser undertakes to remove ONLY the equipment listed and nothing more.
