PHYSICAL AUCTIONS Mercier Belgium organises and carries out public auctions of vehicles and other equipment to which the general provisions of these conditions apply. Mercier Belgium acts as the seller's agent and is therefore not a party to the sale, binding only the buyer and the seller of the lot. Sale assisted by the firm Bogaert - Dupont - Debetencourt - Rochez (Tournai) VEHICLE CHARACTERISTICS HGVs > 3.5 tonnes: vehicles are sold with or without a roadworthiness test and Mercier Belgium informs buyers whether or not this test has been carried out (contact the sales teams if necessary). The content of this inspection is subject to strict and precise regulations. They require roadworthiness tests to be completely independent of any activity related to car repair or trade. Roadworthiness tests are therefore neutral, impartial and objective. In addition, some vehicles returning from long-term hire are presented with their maintenance history. Some vehicles are also subjected to a dynamic inspection, a copy of which is displayed on the windscreen during the public display of vehicles on the premises. PUBLIC EXHIBITION OF LOTS Each sale is preceded by a public exhibition of lots on the sale site (see dates). The main purpose of these exhibitions is to enable future buyers to appreciate the condition and nature of the vehicles offered for sale. Mercier Belgium staff are also on hand to open the vehicles (private cars, light commercial vehicles and heavy goods vehicles), provide access, provide information and assist buyers with their purchase. Most vehicles come with a mechanical warranty, which you can take out with our partner in addition to the sale price (see section). You can also take out temporary insurance for 2, 7, 15 or 30 days, giving you the time you need to compare the various offers from insurance companies. Finally, we can take care of the necessary formalities for registering your vehicle with the prefecture on your behalf, so you don't have to go anywhere (ask reception staff about the conditions). LIVE SALES If you are unable to attend the public auction in person, you can still attend the sale and bid online using our LIVE sales system. To do so, before the sale, you must register here, providing your postal address and a valid email address. This registration is free of charge. Mercier Belgium reserves the right to refuse access to a user. You will also be required to make a bank transfer of 3000 euros including VAT by payment card. Your bank details will be verified by an independent secure payment system. Mercier Belgium does not store bank details. Furthermore, the bank card will not be debited if you are not the winning bidder. If you are a winning bidder via the Internet, the fixed deposit of 3,000 euros inclusive of tax will be converted into a deposit and debited immediately. An invoice will then be issued and the €3000 deposit will be deducted from the amount to be paid. The disclosure of identifiers (e-mail and password) and their use by a third party is the sole responsibility of the Internet user. In the event of non-payment by the due date, the Internet user's account may be closed. ADJUDICATION During the sale, any person making a bid and declared the "successful bidder" for a lot must give the Mercier Belgium staff a document proving their identity (ID card, passport, Kbis extract) as well as a deposit (simple cheque made out to Mercier Belgium, cash or credit card deposit). When the word "adjugé" (awarded) is pronounced by the auctioneer, the last bidder is declared the "successful bidder" for the lot. Any DISPUTE concerning the bids will be immediately settled by the Bailiff officiating at the public sale. METHODS OF PAYMENT The sale is expressly for cash. A copy of the purchaser's identity document and a copy of the identity document of the person collecting the vehicle, if different from the person mentioned on the invoice, will be required. For professionals, the SIRET number will also be required. If the billing address does not match the identity document, proof of address less than 3 months old must be provided. If the person collecting the vehicle is not the purchaser, proof of that person's identity must also be provided. At the time of payment, you will be given a folder containing all the technical and administrative documents for the vehicle (passenger car, light commercial vehicle, heavy goods vehicle) so that you can register the vehicle with the prefecture (transfer of vehicle registration document). Vehicles must be collected no later than the Friday following the sale. After this date, Mercier Belgium will charge the successful bidder a late collection fee of €15 per day (including VAT). In order to collect the vehicle, the successful bidder must have previously taken out car insurance. Mercier Belgium cannot be held responsible in the event of a fine being imposed for lack of insurance. From the moment the vehicle is made available, the successful tenderer is subject to the regulations applicable in terms of the highway code, private or public transport, labour regulations, with regard to equipment that must be brought into compliance, and to all legal obligations linked to the use of the vehicle. EXPORT VEHICLES Common provisions for deliveries within the European Union and exports outside the European Union. The following paragraph only applies to vehicles advertised as "sold with VAT". The car can only be exported if it is advertised as "SOLD WITH ORIGINAL CARTE GRISE". This means that it will be available and not immediately handed over. The car must be exported within a maximum of 8 days following the sale, both within the European Union and to all other countries. Once this period has elapsed, the export is no longer eligible for a VAT refund. In all cases, those wishing to export are asked to check the completeness of the administrative documents in the files. This diligence is the sole responsibility of those wishing to export goods. Mercier Belgium cannot be held responsible for this as each destination country has its own rules. Deliveries in the European Union For professionals, obligation to give prior to the sale: - intra-community VAT number, with proof of validity, - trade register (equivalent to Kbis), - any document proving the identity of the manager (identity card, passport). Exemption from VAT is only possible on condition that the purchaser provides Mercier Belgium with an original bill of lading (CMR) approved by the carrier and the customer proving delivery of the vehicle in another Member State or a copy of the vehicle registration card in the other Member State. Payment must be made by a foreign bank transfer from the purchasing company. Exports outside the European Union The purchaser must go through a forwarding agent referenced by MERCIER BELGIUM (CAR TRANSIT INTERNATIONAL, ROUSSEL or AGENCE EUGENE MUSSCHE). Once the export has been completed within the aforementioned period of 30 days, the purchaser must send MERCIER BELGIUM copy "3" of the "EX 1" document stamped by the customs office of exit of the vehicle. This "EX 1" document must show MERCIER BELGIUM as the sender. The VAT refund will be made within 2 months following the submission of the supporting documents to MERCIER BELGIUM, only by bank transfer in the name of the purchaser or in another name in accordance with an official power of attorney drawn up in French by the purchaser.
