THE SALE AND HOW IT WORKS
Article 1
The sale is public and takes place by auction.
The sale will take place live via the www.interencheres.com website and in the auction room at the Auction House, 15 rue Raymond Poincaré 92000 Nanterre.
Bidders may also send firm orders to the auction house, either by e-mail or during the visit, subject to a bank guarantee and proof of identity in accordance with TRACFIN standards (KBIS, identity document, etc.).
Successful bidders may also take part in the auction by telephone, subject to providing proof of identity and a bank guarantee.
The sale will be made to the highest bidder against cash payment.
In the event of a double bid, the lot will be put back up for sale and the public will be allowed to bid again.
The auctioneer reserves the right to modify the above conditions up to the day of the sale.
Article 2
The sale will take place in the order indicated in the sale catalogue. However, the Auctioneer reserves the right to deviate from the order of the catalogue, to combine or divide lots, or to withdraw lots that do not fetch a price to his satisfaction, even after bids exceeding the reserve price, if the price obtained does not comply with the minimum price expected so as not to constitute a low price. The auctioneer will announce at the beginning of the sale whether a reunion option is proposed for all the lots at the end of the sale or, on the contrary, at the beginning of the sale at a price he deems appropriate.
Article 3
As this is a legal sale, the equipment is sold in the condition in which it is found at the time of the sale, without any guarantee against hidden defects, or any recourse, and without any possible claim once the auction has been pronounced. The potential buyer is deemed to be competent and to have taken note of the condition of the equipment at the exhibitions. The photos used in the various advertisements are not contractual. The dimensions, quantities and qualities shown in the catalogue are given for information only and are not guaranteed.
PAYMENT OF PRICE, CHARGES AND TAXES
Article 4
All sales are inclusive of VAT. The successful bidder will pay, in addition to the auction price, buyers' fees of 11.90% excluding VAT as well as VAT on these fees, i.e. 14.28% including VAT.
To be effective, payment must be made
- either in cash in accordance with current regulations, i.e. €1,000,
- by certified cheque or by cheque accompanied by a bank guarantee (see model in this catalogue),
- or by bank transfer (this method of payment is required for buyers outside France).
Buyers from outside France must pay French VAT at the rate of 20% as a deposit. This sum will be reimbursed on presentation of the transport document for EC buyers, and on presentation of the export document for buyers outside the EC. The buyer has 30 calendar days after the sale to return these documents to SELARL GILLET-SEURAT-MORETTON et Associés.
All bank charges will be borne by the buyer.
Buyers taking part in the sale via the interencheres.live platform must pay an additional 1.8% inc VAT to the auction platform.
TRANSFER OF OWNERSHIP AND GUARANTEES
Article 5
Buyers become responsible for their lots as soon as the sale is announced, but the transfer of ownership will not be effective until final payment has been received. From the time of the auction, the seller cannot be held responsible for the partial or total disappearance of the lot, for any damage that may be caused to it or for any damage that it may cause.
REMOVAL OF LOTS
Article 6
Lots must be collected by the buyer within the time limit announced in the catalogue and/or during the sale.
In the event that lots are not collected within the stipulated time, the seller reserves the right to charge late buyers storage and guarding costs, without being held liable in any way for the condition or conservation of the lots in question. The Auctioneer also reserves the right to invoice the full amount of the monthly rent previously invoiced by the lessor.
The successful bidder will be required to comply strictly with the rules of safety and labour law applicable in France.
Article 7
Unless expressly stipulated otherwise, the gas, water, steam and electricity pipes or any other connection to the lot awarded will be disconnected at the point of the first connection, switch, valve or markings affixed by the vendor to the pipes. Unless otherwise stipulated in the sale catalogue, the successful bidder may not claim any right of ownership over underground pipes or pipes incorporated into masonry elements or electrical cables between transformers and machine control panels.
Article 8
Should it be necessary to dismantle a property in order to remove one or more lots awarded, the purchaser may only proceed to dismantle the property with the agreement of the Ministerial Official and in accordance with the terms and conditions defined in this agreement. A deposit in respect of any damage that may be caused to the building and its installations will be made by the buyer. Should such damage occur, the deposit will be applied to the payment of compensation for the repair of the damage. If the deposit is insufficient to cover the damage caused by the purchaser to the property, the purchaser must pay the full cost of restoring the property. If there is no damage, the deposit will be returned to the buyer.
RESTRICTIONS ON THE SALE OF CERTAIN EQUIPMENT
Article 9
The machines and production elements are sold as is, with the purchaser being responsible for bringing them up to standard before any re-use.
MISCELLANEOUS PROVISIONS
Article 10
These terms and conditions of sale are deemed to be known and accepted without reservation by the purchaser.
