(1.50% VAT excl. and 20% VAT), i.e. 29.80% VAT incl. VAT : Transactions relating to auctions are subject to VAT on the margin at the rate of 20% (except for books at the reduced rate of 5.5%). In application of the 7th VAT Directive applicable from 1 January 1995, the conditions for VAT refunds apply as follows: 1 - Lot exported to a country outside the European Union Additional costs as well as VAT on commissions and additional costs may be refunded to the non-EU resident winning bidder upon presentation of proof of export from the EU, including copy no. 3 of the customs export document, and provided that the export took place within two months of the sale date. The auction house must be listed as the consignor of the said customs document. 2 - Lot exported to an EU country VAT on commissions and additional costs may be refunded to the winning bidder from the EU who can provide proof of an intra-Community VAT number and proof of delivery from France to another Member State, within one month of the date of the sale (after this period, no refund will be possible). Terms of payment: Payment must be made in cash for the full price, including costs and taxes. The successful bidder may pay by the following means: Cash up to €1,000 including fees and taxes for French nationals, for French or foreign professionals. Up to €15,000 including taxes for foreign nationals on presentation of a valid passport. VISA or MASTERCARD credit card. Cheque made payable to DOUTREBENTE & ASSOCIES. Bank transfer (RIB sent on request). All costs associated with the transfer must be borne by the purchaser. If, however, the purchaser does not pay within one month, he will be liable for penalties linked to the flat-rate tax on the sale or export of precious metals, jewellery, works of art, collectors' items or antiques. Combating money laundering and the financing of terrorism (LCB-FT): In application of article L. 561-2, 14° of the French Monetary and Financial Code, the obligations relating to LCB-FT are applicable to DOUTREBENTE SARL in its capacity as a voluntary sales operator for any transaction or series of linked transactions of an amount equal to or greater than €10,000. The successful bidder or his principal undertakes to provide spontaneously and in good faith all documents enabling the establishment of their identity. Depending on the circumstances, the auction operator may be subject to a heightened obligation of vigilance, in which case the successful bidder or his principal undertakes to answer all questions in order to comply with legal obligations. Late payment penalties : Late payment penalties will be applied if the sums due are paid after the day following the sale. The rate will be equal to the interest rate applied by the European Central Bank to its most recent refinancing operation plus 10 percentage points. Late payment penalties are payable without the need for a reminder. Any auction slip which remains unpaid to DOUTREBENTE & ASSOCIES or which has been the subject of a delay in payment may be registered in the TEMIS File. Insurance : As soon as the item is sold, the buyer is entirely responsible for it. The buyer is responsible for insuring his acquisitions himself. DOUTREBENTE & ASSOCIES declines all responsibility for any damage that the acquired object may incur, and this as soon as the auction is pronounced. Reiteration of bids : In the event of non-payment by the successful bidder, after formal notice has been served to no avail, the seller may, within a period of one month following the sale, opt either for the re-sale on the basis of the irresponsible bid of the unsuccessful bidder, or for the automatic cancellation of the sale. If the sale is reopened, the defaulting bidder will have to pay the difference between the price for which he bid and the price finally obtained when the sale was reopened. In all cases, the defaulting buyer may be liable for damages. Maître Doutrebente reserves the right to offset any sums due to the defaulting buyer. Purchase orders and telephone bids : Purchase orders will only be taken into consideration if confirmed in writing (form at the end of the catalogue), accompanied by a photocopy of the bidder's identity document and a means of payment, and received at least 24 hours before the start of the sale. DOUTREBENTE & ASSOCIES declines all responsibility in the event of failure to execute a purchase order. The possibility of bidding by telephone is subject to the same conditions, with DOUTREBENTE & ASSOCIES declining all responsibility in the event that communication cannot be established or in the event of an error relating to the reception of bids by telephone. These are carried out on the www.drouot.com website, which is a technical platform enabling remote electronic participation in public auctions held in auction rooms. The contractual partner of users of the Drouot.com service is Auctionspress. The user wishing to take part in an online auction via the Drouot.com platform must read and accept, without reservation, the conditions of use of this platform (which can be consulted at https://drouot.com), which are independent of and in addition to these general conditions of sale. DOUTREBENTE SARL cannot be held responsible for the interruption of a Live service during a sale or for any other malfunction of such a nature as to prevent a buyer from bidding via a technical platform offering the Live service. The interruption of a Live auction service during a sale does not necessarily justify the auctioneer stopping the auction. In addition to the bids and the auctioneer's fees, purchasers via the Live service will pay a commission of 1.80% (fees of 1.50% excluding VAT and 20% VAT), i.e. 29.80% including VAT for voluntary lots and 16.08% including VAT for judicial lots*. Pre-emptive right of the French State : The French State has a right of pre-emption on works sold. This right is exercised immediately after the auction, with the representative of the State expressing the latter's wish to take the place of the last bidder and confirming the pre-emption within 15 days. Payment of sellers : Maître Doutrebente will be required to pay the seller once he has been paid by the successful bidder.

Guarantees : The items are sold as is. The description of the lot as it appears in the catalogue or resulting from a verbal announcement is only the expression by the Auctioneer of his perception of the lot and does not constitute proof of a fact. Dimensions and weights are given for information only, as are any indications of restoration or defects. The absence of any indication of restoration or defect does not guarantee that the item is free of them. Conversely, the mention of a few defects does not imply the absence of any other defect. The published reproductions of the lots are as faithful as possible to reality but have no contractual value greater than the description in the catalogue, as the proportion of the objects may not be respected and there may be differences in colour or tone. A prior exhibition enables buyers to appreciate the condition of the items offered for sale. No claims will be accepted once the sale has been announced, even on the basis of the published photographs. Delivery of purchased lots : Lots will be delivered only after full payment of the price, costs and taxes. Notwithstanding the law of 31 December 1903, the successful bidder acknowledges and accepts that any items that have not been withdrawn by him within three months will be considered as abandoned and may be sold after a petition has been lodged with the court, and that Drouot will not have to wait a year to proceed with their sale by auction in accordance with the law of 31 December 1903. Consequently, it should be noted that items that have not been removed within the three-month period may be reoffered for sale in order to cover storage costs.
