The sale will be made in cash. The purchasers will pay in addition to the bids:
Voluntary fees of 27% inclusive of tax.
Judicial fees of 14.28 % inclusive of tax.
The last bidder will be considered the successful bidder and will be responsible for payment. He/she must declare his/her name and address as soon as the auction is announced.
Any person who places a bid undertakes to pay personally and immediately the hammer price plus any costs payable by the buyer and any taxes that may be due.
If the bidder is acting on behalf of a third party, he must present an identity document, a power of attorney and documents identifying his proxy. If the proxy fails to act, the bidder will remain liable for the full price.
Lots will only be delivered to the successful bidders once payment has been received and on presentation of two pieces of identification.

If the purchaser buys several lots in the same sale, the ceiling applies to all of these lots, including costs.

Designations of gold and silver objects and jewellery for which no title is mentioned are gold and silver objects and jewellery of first title and in good standing.
Gold, platinum and silver materials will be sold without any guarantee of filling, title or breakage, and those not bearing the Guarantee control marks must be submitted to the control of the aforementioned Administration or broken immediately, at the purchasers' option.
In all cases, these materials may only be removed after completion of the formalities required by the laws and regulations, and payment of the costs and duties by the successful bidders, all under their own responsibility.

GUARANTEES
The attributions of the works offered for sale have been established in the light of scientific and artistic knowledge at the date of the sale. The auctioneer reserves the right to rectify catalogue designations. These corrections will be announced at the time of the presentation of the item and recorded in the sale minutes.
A prior exhibition will enable buyers to appreciate the condition and characteristics of the items offered for sale, and no claims will be accepted once the sale has taken place.
Potential buyers are strongly advised to examine the item(s) they may be interested in before the auction, during our exhibitions, as photographs on the internet and a preliminary description cannot replace a visual and tactile examination.
Indications given as to the existence of any restoration, accident or incident affecting the lot are expressed to facilitate inspection by the potential buyer and remain subject to his personal appreciation.
In the sale of second-hand goods, the absence of any indication of restoration, accident or incident in the catalogue, reports, labels or verbally, in no way implies that a good is free of any present, past or repaired defect.
Estimates are given purely as a guide and cannot be taken to imply any certainty that the property will be sold at the estimated price or even within the estimate range. Estimates do not constitute a guarantee of any kind.
Reproductions of works in the catalogue are as faithful as possible, although differences in colour may occur.
Dimensions are given as an indication only.
Civil liability claims arising from auctions and voluntary and judicial sales of furniture by public auction are subject to a limitation period of five years from the date of the auction. (art. L 321-17 of the French Commercial Code)
AUCTIONS
The order of the catalogue will be followed. The auctioneer may divide or combine lots if he deems it necessary.
APONEM conducts and organises the auctions in the most appropriate manner in accordance with established practice.
The auctioneer alone sets the "bidding steps" and reserves the right to refuse any bid that is not appropriate.
Subject to the decision of the person conducting the sale, the successful bidder will be the person who has made the highest bid, provided that it is equal to or higher than the reserve price.
The blow of the hammer will mark the end of the bidding and the pronouncement of the word "Adjudé" or any other equivalent will result in the formation of the sales contract between the seller and the last successful bidder.
In the event that two people have made identical bids by voice, gesture or telephone and at the same time claim the benefit of the auction after the hammer has sounded, the item will immediately be put back up for sale at the price offered by the last bidders, and all the public present will be able to make new bids.
The successful bidder will not be able to obtain delivery of the lot until the full price, costs and taxes have been paid.
ORDER TO BUY
If you wish to make an offer to purchase in writing, you may use the form available on request from our office. This must be sent to us at least two days before the sale, together with your bank details and proof of identity. If the bid proposed in the auction room is of the same amount as your order, priority will be given to the auction room. If several bids for the same lot are placed for the same amount, only the first bid received by the OVV* will be taken into account.
TELEPHONE BIDDING
If you wish to bid by telephone, please make your request in writing using the form available on request from the auction house, together with your bank details and proof of identity, no later than two days before the sale. The OVV* cannot be held responsible if you are not reached by telephone at the time of the sale, for whatever reason.
No telephone orders will be accepted for lots with a low estimate of less than €200. The request for a telephone line implies that the bidder is acquiring the lot at the low estimate.
WITHDRAWAL OF PURCHASES
The lot will only be delivered to the buyer after full and irrevocable payment of the price, costs and taxes, after an appointment has been made with the auction house.
As soon as the lot has been sold, the buyer takes full responsibility for it. The buyer will be responsible for insuring his acquisitions, and the OVV* declines all responsibility for any damage that the object may incur, as soon as the hammer is down.
The export licence procedure may take between five and ten weeks, although this can be significantly reduced depending on how quickly the buyer provides the auction house with his instructions.
If the successful bidder fails to pay, after formal notice has been served without success, the property will be re-sold at the seller's request on the basis of an irresponsible bid by the unsuccessful bidder; if the seller does not make this request within one month of the auction, the sale will be cancelled ipso jure, without prejudice to any damages owed by the unsuccessful bidder.
In addition, APONEM and SELARL DUMEYNIOU FAVREAU reserve the right to claim from the defaulting buyer:
- reimbursement of any additional costs incurred as a result of its default,
- payment of the difference between the initial hammer price and the hammer price on irresponsible bidding if it is lower, as well as the costs generated by the new bids.
APONEM reserves the right to exclude from future sales any successful bidder who has defaulted or failed to comply with these general terms and conditions of purchase.
