GENERAL TERMS AND CONDITIONS OF PURCHASE
Article 1 – Scope
These General Terms and Conditions of Purchase (hereinafter the ‘GTC’) apply to all participation
in auctions organised by the auction house Rennes Enchères Bretagne, referred to as the ‘Auction House’
in this document, whether the auction takes place in the auction room, live, online or by any other means.
Participation in auctions implies full and unconditional acceptance of these GCP, the
auction rules and, where applicable, the specific conditions applicable to each auction.
Article 2 – Access to auctions and registration of bidders
The Auction House reserves the right to request the following from any potential bidder:
• a valid identity document,
• proof of address,
• bank details,
• a security deposit,
• a Kbis certificate for a company,
• and any document necessary to comply with regulations.
The Auction House may refuse registration or participation in an auction without having to give reasons for its
decision.
NB: For online auctions, participation in the bidding is subject to the prior creation
of a personal account on the Auction House’s online auction platforms.
Article 3 – Description of lots
Lots are described in the auction catalogue, on the website or by notice displayed in the auction room.
These descriptions are drawn up with the utmost care but do not constitute a guarantee.
Information relating to:
• condition,
• restoration,
• authenticity,
• provenance,
• dating,
• estimate (excluding fees, taxes or applicable charges)
are provided for guidance only and reflect the state of knowledge at the time of the sale.
Dimensions, weights, illustrations and other information appearing in the catalogue are provided
for information purposes only.
Photographs are not contractually binding.
Article 4 – Pre-sale viewing
Buyers are invited to examine the lots in person during the public viewings
organised prior to the sale.
Where lots are not on display, or where the buyer is unable to attend, or
in the case of online-only sales, the buyer acknowledges that they are unable to physically inspect
the lots prior to the sale.
They are therefore advised to:
• read the descriptions carefully,
• request, prior to the sale, any further information or a condition report.
No claims regarding the condition of the lots will be accepted after the auction has been concluded.
Article 5 – Conduct of the Auction
Bidding takes place in euros:
• in the auction room,
• by telephone,
• by written bid,
• online.
The Auction House reserves the right:
• to refuse any bid,
• to withdraw a lot,
• to group together or separate lots,
• to change the order in which lots are presented.
The auctioneer, acting as sale director, is the sole arbiter of the bidding and the award of lots.
Article 5a – Conduct of online auctions
Auctions are then conducted in accordance with the terms and conditions specified on the platform(s).
Auctions may be:
• progressive, with automatic increments,
• time-limited,
• automatically extended in the event of a last-minute higher bid (‘anti-sniping’).
Article 6 – Award of the Lot
The highest bidder and last bidder shall be declared the successful bidder.
The award of the lot entails the immediate formation of a contract of sale between the seller and the buyer.
In the event of a dispute, a tie or an obvious error, the Auction House reserves the right to
put the lot back up for sale.
For live and online sales, in the event of a technical error, system malfunction or
serious dispute, the Auction House reserves the right to cancel the auction or to put the
lot back up for sale.
Article 7 – Purchase price and fees
The purchase price comprises:
• the hammer price,
• plus the buyer’s premiums indicated in the catalogue or announced prior to the sale, as well as
the fees charged by the platforms,
• and any applicable taxes (VAT, resale right, etc.).
Buyers’ fees are payable by the successful bidder.
Article 8 – Payment
Payment must be made in full and immediately after the sale, unless otherwise agreed in
writing in advance.
Accepted methods of payment:
• bank transfer,
• credit card (Mastercard or Visa only),
• exceptionally, in cash (within legal limits),
As the Auction House is required to comply with legal requirements regarding the prevention of money laundering and
the financing of terrorism, it reserves the right, in particular, to enquire about the origin of the funds
presented and to request a sworn statement to that effect.
No lot will be released until the sums due have been paid in full.
Article 9 – Failure to pay
In the event of failure to pay within the specified time limit:
• the sale may be rescinded as of right,
• the lot may be put up for sale again,
• the defaulting buyer may be entered in the payment incidents register accessible to
all auction houses,
• penalties and charges may be applied.
Article 10 – Collection and Delivery of Lots
Lots must be collected at the buyer’s expense and under their sole responsibility, within the time limits
specified.
Risk passes to the buyer upon the award of the lot.
Lots not collected by the buyer by the end of a 30-day period following the sale
(including the day of the sale) will be invoiced as follows: -
Lot on the shelf: €1.80 (incl. VAT) per day -
Lot off the shelf: €7.50 (incl. VAT) per day
Article 11 – Export
The export of lots is the responsibility of the buyer.
Certain works may be subject to customs or administrative formalities (export
certificate, CITES, etc.).
The Auction House shall not be held liable for any refusal to grant an export licence.
Article 12 – Liability
The Auction House’s liability is limited to the amount of buyer’s premiums charged for the lot
in question.
For live and online sales, the Auction House shall not be held liable for
technical faults beyond its control (service interruptions, bugs, network
outages). The buyer acknowledges that they have been informed of the technical rules specific to live and online sales
and accepts any potential issues relating to internet connections or IT systems.
No liability shall be accepted in the event of force majeure.
Article 13 – Right of withdrawal
In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply
to public auctions, including where they are conducted exclusively online
except where the seller is a trader acting for purposes falling within the scope of their
business. In such cases, the cost of returning the goods shall be borne by the buyer.
Article 14 – Personal data
Personal data collected is processed in accordance with the regulations in force.
The buyer has the right to access, rectify and delete such data.
Article 15 – Applicable law and competent jurisdiction
These General Terms and Conditions are governed by French law.
Any dispute relating to their interpretation or enforcement falls within the exclusive jurisdiction of the
courts in the jurisdiction where the auction house’s registered office is situated.
