Terms of sale
Special conditions:
The sale price includes all taxes (TTC), plus legal fees. The following charges will be levied in addition to the hammer price: 22.6 (including tax) + 1.5% (excluding tax) for live purchases, or €60 (excluding tax) per vehicle purchased live Payment must be made in cash. Goods and equipment may only be collected once payment has been received in full. All costs of any kind whatsoever, including, in particular, handling charges or other costs relating to the ownership of the goods and equipment and to collection, shall be borne in full by the purchaser; Collection shall be at the expense and under the sole responsibility of the successful bidder, who must therefore provide the necessary equipment to ensure it proceeds smoothly (handling equipment, sufficient staff, jump leads for vehicles, etc.). The successful bidder shall also be solely liable for any damage or disruption caused during collection. All assets must be collected within the time limits announced by the auctioneer, namely: No later than the 20th day following the sale; storage charges may subsequently be invoiced at a rate of 5 euros per day’s delay per lot should this deadline be exceeded. For lots to be collected from a location other than the auction house, these must be collected on site at the address specified in the special conditions, during the time slots and at the address indicated. No collection time slots other than those specified in the special conditions will be granted. The buyer accepts the goods and equipment in their current condition, at their current storage location and under their current customs status. The sale shall take place without any warranty of any kind, in particular as regards description, quality, quantity (any over- or under-quantity shall be to the benefit of the successful bidder), size or capacity, unless otherwise stated in the minutes recording the information provided to the public at the time of the sale. As the information provided is for guidance only, no claims will be accepted once the lot has been awarded. The auctioneer, by virtue of his status, is an agent acting on behalf of the seller, and it is the seller of the lot in question who is solely responsible for declaring and paying VAT to the relevant tax authorities. The appointed auctioneer, the valuer working alongside them, who issues the invoice, cannot be held liable unless they fail to report to the seller or provide incorrect or fraudulent information on the report, the invoice or any document serving the same purpose. Any damage caused during collection, or arising from removal, dismantling or transport, shall be borne by the successful bidders. All water inlets must be sealed with plugs, and fuses must be fitted following the dismantling of electrical equipment. The lot awarded shall remain at the successful bidders’ own risk from the moment the bid is declared successful, even if delivery does not take place for any reason whatsoever, in particular whilst awaiting the correct method of payment. If the lots purchased contain waste or toxic substances of any kind, the purchaser is advised that these must be disposed of in accordance with the laws and regulations in force. In the event of any dispute, the courts of Cherbourg shall have exclusive jurisdiction.

Any auction invoice remaining unpaid to SAS BOSCHER ENCHERES, or for which payment is overdue, may be recorded in the TEMIS database.
