Warranties:
Items are sold as seen. The description of a lot as set out in the catalogue or given verbally constitutes merely the Auctioneer’s perception of the lot and shall not be deemed proof of any fact. Dimensions and weights are given for guidance only, as are details regarding any restoration or defects. The absence of any mention of restoration or defects does not guarantee that the item is free from them. Conversely, the mention of certain defects does not imply the absence of any other defects. The published reproductions of the lots are as faithful as possible to the actual items but have no greater contractual value than the description provided in the catalogue; the proportions of the objects may not be accurately represented, and differences in colour or tone are possible. A pre-auction viewing allows buyers to assess the condition of the items offered for sale; no claims will be accepted once the lot has been awarded, even on the basis of the published photographs.
In accordance with Regulation (EU) 2024/1689, any use of Artificial Intelligence in the modification or generation of photographs or sales visuals will be indicated where applicable.
NO CONDITION REPORT WILL BE PROVIDED FOR THIS SALE.

Lots will only be released upon full payment of the purchase price, fees and taxes. In the event of payment by uncertified cheque or bank transfer, the release of the items will be deferred until the funds have been definitively cleared. The lots awarded shall remain at the risk and expense of the successful bidders from the moment the bid is declared, even if they have not yet been released.
DOUTREBENTE & ASSOCIES accepts no liability for handling or storage. DOUTREBENTE & ASSOCIES is not responsible for transport costs after the sale. Should it agree to arrange transport on an exceptional basis, it shall not be held liable in the event of loss, theft or accidents, the responsibility for which remains with the buyer.

Notwithstanding the Act of 31 December 1903, the successful bidder acknowledges and agrees that any goods not collected by them within three months shall be deemed abandoned and may be sold following the lodging ofan application to the court, and that Drouot will not be required to wait one year to proceed with their auction in accordance with the Act of 31 December 1903.
Consequently, it is hereby reiterated that items which have not been collected within three months may be put up for sale again in order to cover storage costs.
By way of a contractual extension of the Act of 31 December 1903—which permits only the sale of abandoned items but does not entitle the custodian to seek a court order to destroy them—the successful bidder expressly acknowledges that items of low market value (i.e. goods with a purchase price to the successful bidder of less than 50 euros) which have not been collected by the successful bidder within six months shall be deemed to have been definitively abandoned by the successful bidder. Ownership of such items shall then pass to TSE, which may destroy them after sending a registered letter with acknowledgement of receipt (LRAR) to which no reply has been received within one month, without having to seek a court order as referred to in Article 2 of the Act of 31 December 1903 concerning the sale of abandoned property. In any event, in the event of destruction, the successful bidder may under no circumstances claim any loss in excess of the purchase price paid by the successful bidder for the destroyed item.
Insurance:
Upon the award of the lot, the item becomes the sole responsibility of the successful bidder. The purchaser is responsible for insuring their purchases themselves.
DOUTREBENTE & ASSOCIES accepts no liability for any damage the purchased item may sustain, with effect from the moment the bid is declared successful.
Re-auction:
In the event of non-payment by the successful bidder, following a formal notice that has remained unheeded, the seller may, within one month of the sale, choose either to re-auction the item following the defaulting successful bidder’s failure to pay, or to have the sale automatically rescinded. In the event of a resale, the defaulting successful bidder shall be required to pay the difference between the price at which they were declared the successful bidder and the price finally realised at the resale. In all cases, the defaulting successful bidder may be liable for damages. Maître Doutrebente reserves the right to set off any amounts due against sums owed by the defaulting successful bidder.
Purchase orders and telephone bids:
Purchase orders will only be considered if confirmed in writing (using the form at the end of the catalogue), accompanied by a photocopy of the bidder’s identity document and details of a means of payment, and received at least 24 hours before the start of the sale. DOUTREBENTE & ASSOCIES accepts no liability in the event of failure to execute a purchase order. Bidding by telephone is subject to the same conditions; DOUTREBENTE & ASSOCIES accepts no liability in the event that a connection cannot be established or in the event of an error relating to the receipt of telephone bids. Please note: telephone conversations may be recorded during auctions.
Bidding via Drouot.com:
An online bidding option is available. Bids are placed on the website www.drouot.com, which serves as a technical platform enabling remote electronic participation in public auctions taking place in auction houses. The contractual partner for users of the Drouot.com service is Auctionspress. Users wishing to take part in an online auction via the Drouot.com platform must read and accept, without reservation, the terms and conditions of use for this platform (available at https://drouot.com), which are separate from and in addition to these general terms and conditions of sale. DOUTREBENTE & ASSOCIES shall not be held liable for the interruption of a Live service during a sale or for any other malfunction that may prevent a buyer from bidding via a technical platform offering the Live service. The interruption of a live auction service whilst the sale is in progress does not necessarily justify the auctioneer bringing the auction to a close. Buyers using the Live service shall pay, in addition to the hammer price and the auction house’s fees, a commission of 1.80% (1.50% excluding VAT plus 20% VAT), i.e. 29.80% inclusive of VAT for voluntary lots and 16.08% including VAT for judicial lots *.
Five-year limitation period:
Pursuant to Article L321-17 of the Commercial Code: ‘Civil liability claims arising from valuations and voluntary and judicial sales of movable property at public auction are subject to a limitation period of five years from the date of the award or valuation. Reference to this limitation period must be included in the notice provided for in Article L321-11.
Right of pre-emption of the French State:
The French State has a right of pre-emption over the works sold. This right is exercised immediately after the auction, with the State’s representative then expressing the State’s intention to take the place of the highest bidder and being required to confirm the pre-emption within 15 days.
Payment to sellers:
Maître Doutrebente shall be obliged to pay the seller once he has been paid by the successful bidder.
