The sale is governed by Article L312-4 of the Commercial Code. The auctioneer, SVV L’Huillier et Associés, acts as the seller’s agent, and its relationship with bidders is governed by these terms and conditions of sale.
Payment of the purchase price: The sale is conducted in euros and is expressly on a cash-only basis. In addition to the hammer price, the successful bidder must pay sales taxes and fees amounting to 30 per cent (including VAT), and 14.40 per cent (including VAT) for judicial lots.
Items offered for sale: The auction house and the experts assisting it are liable for the information provided in the catalogue, subject to any corrections announced at the time of the item’s presentation and recorded in the sale minutes. Re-lining, re-panelling or re-lining are considered to be a preservative measure and not a defect; dimensions, weights and estimates are indicative. A pre-auction viewing allows buyers to assess the condition of the items offered for sale. No complaints will be accepted. SVV L’Huillier et Associés is at your disposal for any enquiries and invites all interested parties to find out more about the lots.
Watches: Restorations, technical specifications, modifications, serial numbers, dimensions and weights are provided to the best of our ability. This information is provided for guidance only and remains subject to the buyer’s own judgement. Neither the auctioneer nor the expert shall be held liable for any omissions that may remain despite the precautions taken. The absence of any information does not in any way imply that a watch is free from defects. No guarantee is given as to the condition of the watches or their straps. Servicing, adjustments and water resistance testing remain the responsibility of the purchaser. No claims will be accepted once the lot has been awarded.
Auctions: The successful bidder shall be the highest bidder and the last person to bid, and shall be required to provide their name and address, together with proof of identity and bank details. All bidders are deemed to be bidding on their own behalf and are solely responsible for their bids. If a bidder is bidding on behalf of a third party, they must disclose that person’s identity in advance so that the invoice can be issued correctly. No alterations may be made after the sale. In the event of a tied bid recognised as valid by the auctioneer, the lot will be put up for auction again immediately, and any interested party will be invited to bid once more. The auctioneer and the experts reserve the right, in the interests of the sale, to combine, split or withdraw any lot from the sale.
Purchase orders: The auction house may, free of charge, execute any purchase order submitted in writing, online or by telephone. Such requests must be made in writing at least 24 hours before the auction. SVV L’huillier et Associés will act on behalf of the bidder in accordance with the instructions specified in this form, with the aim of attempting to purchase the lot in question at the lowest possible price, without exceeding the maximum amount indicated. In the event of competing bids in the auction room for the same amount, the bidder present in the room will have priority. Telephone bids are accepted for lots with a low estimate of more than €300. The auction house accepts no liability for failing to execute a purchase order due to error, omission or a fault with the telephone line, the internet or Drouot Live, or for any other reason.
No lot will be released to the buyer until all sums due have been paid in full.
Methods of payment:
- By cheque, which must be accompanied by proof of identity; only the cashing of an uncertified cheque constitutes payment and transfer of ownership. Cheques drawn on a foreign bank will only be accepted with the prior consent of the Auction House. To this end, buyers are advised to obtain, prior to the sale, a letter of credit from their bank for an amount approximating their intended purchase, which they shall forward to the Auction House.
- In cash, subject to a limit of €1,000 (including taxes and fees) for French resident private individuals and professionals, and €15,000 for foreign private individuals, upon presentation of proof of identity, the source of the funds and their declarations of the sums to the customs authorities, Decree No. 2010-662 of 16 June 2010.
- By bank transfer, quoting the payment reference number.
- By Visa and MasterCard.
VAT: The VAT included in the margin may be refunded to buyers who are non-residents of the European Union upon submission to the SVV of the customs export document (copy No. 3), stamped by customs, within two months of the sale. No invoice excluding VAT will be issued without official proof of export; an intra-Community VAT number alone is not sufficient.
Non-payment: Payment by a cheque without sufficient funds or failure to pay shall not render the Auction House liable and shall consequently release it from its obligation to pay the seller. Upon expiry of a one-month period following formal notice being served on the purchaser by registered letter with acknowledgement of receipt

Any auction invoice remaining unpaid to L'Huillier or for which payment is overdue may be entered into the TEMIS register.

The TEMIS Register records payment incidents relating to auction invoices (delays and defaults), regardless of how bidders participate (in person or remotely), and may be consulted by all auction houses subscribed to the service.
Bidders are informed that, should they fail to settle their auction invoice within the time limit stated on the invoice, L’Huillier may initiate proceedings to have them entered in the said register.
