The sale shall be conducted strictly on a cash-only basis; that is to say, the full amount stated on the sales slip must be paid at the time of purchase and upon receipt of the sales slip.
No claims will be accepted once the lot has been awarded, as the successive viewings have enabled buyers to assess the condition of the items on display.
The successful bidder shall be the highest bidder and the last person to bid, and shall be required to provide their name, postal address and proof of identity.
In addition to the hammer price, they must pay, per lot, the
following fees and taxes:
• 27% including VAT (i.e. 25.6% excluding VAT (VAT at 5.5%) for books, and 22.5% excluding VAT (VAT at 20%) for all other lots)
• 14.28% including VAT (i.e. 11.90% excluding VAT) for lots 14, 159, 162, 163, 164 and 165, which are being sold by SELARL Kapandji-Morhange

Successful bidders using this platform will be required to pay an additional platform usage fee of 1.5% excluding VAT, or 1.8% including VAT.
GUARANTEE
All lots, whether modern or antique, are sold under the guarantee of the auctioneers and, where applicable, the expert assisting them, in accordance with the descriptions given in the catalogue and subject to any corrections announced at the time of the lot’s presentation and recorded in the minutes.
As a pre-sale viewing is held to enable buyers to assess the condition of the items offered for sale, no claims will be accepted once the lot has been awarded, in particular regarding routine restoration work—which constitutes a preservative measure—minor damage, stains or tears, the condition beneath gilding, paint or lacquer, the external appearance, creases, water stains and various types of foxing, the dimensions of the lots and their condition. Dimensions, weights and sizes are given for information only, and the auctioneers accept no liability in this regard. In accordance with Article L321-7 of the Commercial Code, civil liability claims arising from valuations and voluntary or judicial sales of furniture at public auction.
Neither the descriptions nor the estimates engage the liability of KÂ-MONDO; they are provided for information purposes only. Prospective buyers are invited to request further information on the condition of lots by emailing a request for a condition report.
KÂ-MONDO hereby informs you that it reserves the right to withdraw one or more lots and/or to amend descriptions prior to the start of the sale.
All registrations on Drouot.com must be accompanied by a copy of an identity document for individuals, or a KBis certificate for legal entities.
The firm shall not be held liable for any failure of the technical resources made available to clients (the internet and any other means).
AUCTIONS:
The successful bidder shall be the highest bidder and the last person to bid, and shall be legally obliged to provide their name and address, as well as a valid identity document (a recent KBis extract and a power of attorney for legal entities). Lots and their accessories shall only be handed over to the successful bidders once all sums due have been paid in full. In the event of payment by bank transfer, the handover of the items may be deferred until the funds have been cleared.
Should the successful bidder fail to pay the hammer price plus all charges for which they are liable as soon as possible, the lot will be put up for resale following a re-auction of the defaulting successful bidder’s lot, and their account will be suspended.
The unsuccessful bidder shall be automatically liable to pay the difference between their successful bid and the resale price, following a re-auction, without being entitled to claim any excess, if any.
The successful bidder shall be liable for interest on the hammer price from the date of the auction until the date of the resale, without prejudice to any claim for damages; under no circumstances may they reclaim any sums paid as a result of the auction.
The KÂ-MONDO auction house reserves the right to set off any amounts due against sums owed to the defaulting successful bidder. Similarly, the KÂ-MONDO auction house
reserves the right to exclude from its future sales any successful bidder who has failed to comply with these terms and conditions of sale.
Once the bid has been declared successful, the purchases are the sole responsibility of the successful bidder.
PAYMENT:
The sale is for cash only and conducted in euros.
Payment must be made immediately after the sale.
The successful bidder may make payment by the following means:
– in cash: up to 1,000 euros, including fees and taxes, for French private individuals and professionals; up to 15,000 euros, including fees and taxes, for foreign private individuals (i.e. non-professionals), upon presentation of their identity document.

DELAY OR FAILURE TO PAY
PREVENTION OF UNPAID INVOICES – AUCTION ACCESS RESTRICTIONS REGISTER
KÂ-MONDO subscribes to the TEMIS service, which enables it to consult and update the register of restrictions on access to auctions (TEMIS Register). By participating in the auction, you acknowledge that you have been informed that:
• any auction invoice that remains unpaid or is subject to late payment may be recorded in the TEMIS Register and may restrict your ability to participate in auctions;
• important notifications regarding the outcome of the auction will be sent to you at the email and/or postal address provided to KÂ-MONDO or to the
Live platforms. If you are listed on the TEMIS Register, KÂ-MONDO may make access to its services conditional upon the use of specific payment methods or guarantees, or may refuse you access to certain services for which such guarantees cannot be provided. The TEMIS Register is managed by the company Commissaires-Priseurs Multimédia (CPM). It may be consulted by all auction houses operating in France that are subscribers to the service. Your entry will be automatically deleted after a maximum of 24 months if you are listed only once, and after a maximum of 36 months if you are listed multiple times. To find out whether you are listed on the TEMIS Register and by which auction house(s) that subscribe to the service, you may write to Commissaires-Priseurs Multimédia, 37 rue de Châteaudun, 75009 Paris, France, or to

To contest the inclusion of a lot, once you have received a reply from CPM, you must contact the organisation responsible for your inclusion so that it can update your details. The other live auction platforms used for our sales enable us to report a non-paying bidder and thereby block their account.
INSURANCE
Once the bid has been accepted, the lots become the sole responsibility of the buyer. It is the buyer’s responsibility to insure the lots from the moment the bid is accepted. Lots not collected will be stored at the buyer’s expense and risk.
KÂ-MONDO will not be held liable in any way for these items in storage.
