Warranties:
Items are sold as is. The description of a lot as set out in the catalogue or given verbally constitutes merely the Auctioneer’s perception of the lot and shall not be deemed proof of any fact. Dimensions and weights are given for guidance only, as are details regarding any restoration or defects. The absence of any mention of restoration or defects does not guarantee that the item is free from them. Conversely, the mention of certain defects does not imply the absence of any other defects. The published reproductions of the lots are as faithful as possible to the actual items but have no greater contractual value than the description provided in the catalogue; the proportions of the objects may not be accurately represented, and differences in colour or shade are possible. A pre-auction viewing allows buyers to assess the condition of the items offered for sale; no claims will be accepted once the lot has been awarded, even on the basis of the published photographs.
In accordance with Regulation (EU) 2024/1689, any use of Artificial Intelligence in the modification or generation of photographs or sales visuals will be indicated where applicable.
Delivery of purchased lots:
Lots will only be delivered once the full price, fees and taxes have been paid. In the event of payment by uncertified cheque or bank transfer, delivery of the items will be deferred until the funds have been definitively cleared. Lots awarded shall remain at the risk and expense of the successful bidders from the moment the bid is declared successful, even if delivery has not yet taken place.
DOUTREBENTE & ASSOCIES accepts no liability for handling or storage. DOUTREBENTE & ASSOCIES is not responsible for transport costs following the sale. Should it agree to arrange transport on an exceptional basis, it shall not be held liable in the event of loss, theft or accidents, the risk of which remains with the buyer.
Collection of purchases:
For sales at the Hôtel Drouot, lots may be collected free of charge from the auction room no later than 1 (one) hour after the end of the sale and between 8.00 am and 10.00 am the following day (except on certain Saturdays, as per the auction house’s opening schedule). After this time, lots not collected from the auction house will be stored at the Hôtel Drouot’s warehouse. No lot will be returned to the auction house, unless this condition has been contractually amended, negotiated prior to the sale and subject to a written agreement from DOUTREBENTE & ASSOCIES.

Insurance:
Upon successful bid, the item becomes the sole responsibility of the successful bidder. The purchaser is responsible for insuring their purchases themselves.
DOUTREBENTE & ASSOCIES accepts no liability for any damage the purchased item may sustain, with effect from the moment the bid is declared successful.
Re-auction:
In the event of non-payment by the successful bidder, following a formal notice that has remained unheeded, the seller may, within one month of the sale, choose either to put the item up for resale by re-auctioning it to the defaulting successful bidder, or to have the sale automatically rescinded. In the event of a resale, the defaulting successful bidder shall be required to pay the difference between the price at which they were declared the successful bidder and the final price obtained at the resale. In all cases, the defaulting successful bidder may be liable for damages. Maître Doutrebente reserves the right to set off any amounts due against sums owed by the defaulting successful bidder.
Purchase orders and telephone bids:
Purchase orders will only be considered if confirmed in writing (using the form at the end of the catalogue), accompanied by a photocopy of the bidder’s identity document and details of a means of payment, and received at least 24 hours before the start of the sale. DOUTREBENTE & ASSOCIES accepts no liability in the event of failure to execute a purchase order. Bidding by telephone is subject to the same conditions; DOUTREBENTE & ASSOCIES accepts no liability in the event that a connection cannot be established or in the event of an error relating to the receipt of telephone bids. Please note: telephone conversations may be recorded during auctions
Bidding via Drouot.com:
An online bidding service is available. Bids are placed on the website www.drouot.com, which is a technical platform enabling remote electronic participation in public auctions taking place in auction houses. The contractual partner for users of the Drouot.com service is Auctionspress. Users wishing to take part in an online auction via the Drouot.com platform must read and accept, without reservation, the terms and conditions of use for this platform (available at https://drouot.com), which are separate from and in addition to these general terms and conditions of sale. DOUTREBENTE & ASSOCIES shall not be held liable for the interruption of a Live service during a sale or for any other malfunction that may prevent a buyer from bidding via a technical platform offering the Live service. The interruption of a live auction service whilst the sale is in progress does not necessarily justify the auctioneer bringing the auction to a close. Buyers using the Live service shall pay, in addition to the hammer price and the auction house’s fees, a commission of 1.80% (1.50% excluding VAT plus 20% VAT), i.e. 29.80% inclusive of VAT for voluntary lots and 16.08% including VAT for judicial lots *.
The French State’s right of pre-emption and cultural property:
The French State has a right of pre-emption over the works sold. This right is exercised immediately after the lot is awarded, with the State’s representative then expressing the State’s intention to take the place of the highest bidder and being required to confirm the pre-emption within 15 days. The export of certain cultural property is subject to the obtaining of a certificate of free circulation. The time taken to obtain such a certificate shall under no circumstances justify a delay in payment. DOUTREBENTE & ASSOCIES and/or the seller shall under no circumstances be held liable in the event of the authorities refusing to issue the said certificate.
Five-year limitation period:
Pursuant to Article L321-17 of the Commercial Code: ‘Civil liability claims arising from valuations and voluntary or judicial sales of movable property at public auction shall be time-barred after five years from the date of the award or valuation.
