Saxoferratus, Bartolus de – Andreae, Johannes (d’Andrea, Giovanni)
An introductory work to the books of both systems of law. Various treatises and procedural texts on both systems of law: adapted for the benefit of many students. Basel: Adam Petri, 1517. 122 leaves. Marbled paper cover.
Third edition of this legal anthology, based on the 1513 and 1514 prints, published in Basel in 1517 by Adam Petri. The title announces ‘Treatises and various forms of legal proceedings from both systems of law, for the benefit of many students’. The collection is thus aimed at students and practitioners of both Roman and canon law (utrumque ius). It brings together in a handy volume texts that were used in university teaching and in judicial and notarial practice. The volume opens with an introduction to both systems of law (In utriusque iuris libros introductorium), followed by a guide to deciphering the abbreviations that are ubiquitous in legal manuscripts and printed works (Modus legendi abbreviaturas in utroque iure). At its heart lies the *Tractatus iudiciorum* by Bartolus de Saxoferrato, the ‘legum doctor’, which deals with judicial proceedings. This is followed by texts of a practical nature: a treatise on the renunciation of benefices in public deeds (Tractatus renunciationum beneficiorum in publicis instrumentis) and an *Ars notariatus*, that is, a guide to notarial practice. The *Processus Sathanae infernalis et genus humanum* follows in the tradition of medieval fictional legal literature. It depicts the Devil bringing a lawsuit against the human race and illustrates procedural rules in narrative form. From Giovanni d’Andrea, the volume includes the *Summa* on the second book of the Decretals (*Summa super secundo Decretalium*), which deals with ecclesiastical procedural law. In addition, it includes the ‘Arbores’ (family trees) on consanguinity, affinity, and spiritual and legal kinship (consanguinitatis, affinitatis, cognationis spiritualis et legalis). These were indispensable for matrimonial law and the question of impediments to marriage. Bartolus de Saxoferrato (1313–1357) taught as a professor of law in Perugia. He is regarded as one of the most significant jurists of medieval Roman law and as the foremost representative of the post-glossators (commentators), a group of northern Italian jurists who wrote on Roman civil law. Famous even during his lifetime, he was later regarded as the greatest jurist following the rediscovery of Roman law. Giovanni d’Andrea (c. 1270–1348) was the best-known and most successful canonist of the late Middle Ages. His works shaped the teaching of canon law for generations.
