Description
Middle Ages – Gregory IX Fragment of a late medieval manuscript. 2 leaves. (4 pages). Featuring numerous decorative Lombardic letters in red and blue, some with feather-and-stalk ornamentation. Decretales Gregorii IX (also known as the Liber Extra), from Book II: De appellationibus. 49 lines. Two columns. Latin manuscript on parchment. Gothic Textualis with Rotunda tendencies. Text area 22.2 x 13.7 cm. (30.2 x 20.9 cm). Southern Europe, c. second half of the 13th century (c. 1240–1290). On the history of transmission, see also: Bertram, ‘Decorated manuscripts of the Decretals of Gregory IX (Liber Extra) from the perspective of textual and manuscript research’, 2008. – Provenance: estate of a bookbinder. – Fragment of waste paper from a binding. - A rare and early example relating to the *Liber Extra*. Alongside the *Decretum Gratiani*, it is regarded as the most important collection of ecclesiastical law of the Middle Ages and the Early Modern period. ON PALEOGRAPHY: The scribe makes extensive use of abbreviations. The softer breaks, Iberian place names in the text (Zamora, Ávila) and the red-and-blue filigree decoration suggest a scriptorium in southern France or the Iberian Peninsula – possibly associated with a Castilian cathedral school or university. The quality of the initials and the regularity of the script suggest a relatively early copy, possibly dating from the first or second generation of the tradition. The absence of extensive glossary material (the Glossa ordinaria by Bernard of Parma was completed c. 1245) could indicate an early copy, or a working manuscript without standard commentary. CONTENTS: The pages presented here belong to Liber II (Book Two) of the Decretals, which deals with procedural law (iudicium). In particular, these are texts from Titulus XXVIII: De appellationibus, recusationibus et relationibus (On appeals, recusations and reports). This is one of the most extensive and legally significant titles in the entire work. The Decretals deal with disputes concerning appeals to the Apostolic See, abusive (frustratory) appeals, and specific conflicts between bishops and clerics in the Spanish dioceses of Ávila and Zamora. Classic papal formulae such as *Pervenit ad nos* and *Ad aures* are evident. - Verso with traces of glue from the binding. - From a palaeographic and content-related perspective, the codex represents a valuable testimony to the reception of canon law on the Iberian Peninsula in the 13th century. The softer angularity of the script, Iberian place-names in the text (Zamora, Ávila), and the red-and-blue filigree decoration point to a South-French or Iberian scriptorium, possibly within the milieu of a Castilian cathedral school or university.
