Mittermaier, Carl Josef Anton
Criminal Legislation in its Development: Examined in the Light of Scholarly Requirements and Experience Regarding the Value of New Legislation, and the Difficulties of Codification, with Particular Reference to the Course of Deliberations on Drafts of Criminal Legislation in Constitutional States. 2 volumes in 1. Heidelberg, Winter, 1841–43. 1 folio, viii, 309 pp., 1 folio, iii, 399 (recte 299) pp. (Late) half-leather binding with gilt lettering. (Original cover bound in) (slightly rubbed, spine faded).
First printing of the original edition, rare. – ADB 22, pp. 25–33 – Kleinheyer/Schröder p. 178: “The ‘most internationally renowned of all German jurists of his time’ (Radbruch) occupies a special position amongst the leading criminal law scholars of the 19th century in that he cannot be classified under any of the ‘theories of crime’”. - The book is regarded as a milestone in modern comparative law. In this work, Mittermaier breaks radically with the purely philosophical and abstract legal doctrine that dominated in Germany at the time (as espoused, for example, by Kant or Hegel). He argues that laws must not only be logically justified but must also prove their worth in practice. He systematically examines the real-world effects of new criminal laws on crime rates and society. - Towards the end, water damage along the right-hand outer margin; slightly foxed and browned; bookplate on the inside cover.
