General Terms and Conditions of Sale The Auctioneer conducts the public auction and carries out the valuation. He may be assisted by a consultant or a specialist valuer. ESTIMATES In the catalogue, the estimated sale price is shown after each lot. This is for guidance only; the hammer price may vary. TERMS OF SALE The successful bidder shall be the highest and final bidder, and shall be required to provide their name and address. The authorised auctioneer has the discretion to refuse any bid, to conduct the auction as he deems fit, to withdraw any lot from the sale, to combine or separate one or more lots and, in the event of an error or dispute during or after the sale, to designate the successful bidder, to continue the auction, to cancel the sale or to put any lot back up for sale in the event of a dispute. In the event of a dispute at the time of the auction, that is to say, if it is established that two or more bidders have simultaneously made an equal bid, either aloud or by signal, and are both claiming the item at the same time after the word ‘sold’ has been pronounced, the item in question shall immediately be put up for auction again at the price offered by the bidders, and all members of the public present shall be permitted to bid once more. Any amendments to the terms of sale or the catalogue descriptions shall be announced verbally during the sale and recorded in the minutes. No lot shall be handed over to the successful bidders until all sums due have been paid in full. SALE CHARGES In addition to the hammer price, the successful bidder shall pay the following charges per lot:  12% including VAT for voluntary sales. PAYMENT 1 - The sale will be conducted in euros. PURCHASE ORDERS A bidder unable to attend the sale must complete the purchase order form included in this catalogue, available online, or via ‘live’ online auctions on the various websites listed on the homepage. The Auction House will act on behalf of the bidder. Written purchase orders or telephone bids are a service provided for clients’ convenience. Neither Adjug’Art Brest nor the auction house can be held liable in the event of any errors. IMPORTANT NOTICE TO BUYERS, STORAGE AND COLLECTION OF PURCHASES Adjug’Art Brest advises buyers to examine the condition of the lots they are interested in carefully before the sale. To assist them in this, condition reports are made available. The information provided not only in the reports but also in the catalogues is merely an expression of opinion. To this end, the absence in the catalogue or condition report of references to ‘restorations, damage…’ in no way implies that a vehicle or object is free from any defects or restoration. Similarly, a specific mention does not imply that an item is free from any other defects. Under no circumstances can it fully replace a personal inspection by the prospective buyer. Consequently, no claims will be accepted once the bid has been declared. 1 – Vehicles, motorbikes and bicycles may be collected after full payment has been made, on Monday 26 and Tuesday 27 October from 8.00 am to 6.00 pm sharp, by appointment. Items on site may also be collected. Items (excluding vehicles, motorbikes and bicycles) will then be transported to the auction house at 13 Rue Traverse, Brest. Vehicles, motorbikes and bicycles that have been sold but not collected by their buyers will be transported and stored free of charge for 8 days in a secure, covered facility in the Brest area. Beyond this period, storage, insurance and logistics costs will be borne by the successful bidders at a rate of €20 (excl. VAT) per calendar day and per lot. PAYMENT ISSUES ACCESS RESTRICTIONS REGISTER FOR AUCTIONS (TEMIS) Any auction invoice remaining unpaid following an Adjug’Art Brest auction, or for which payment has been delayed, may be entered into the Auction Access Restrictions Register (“ TEMIS Register”) operated by Commissaires-Priseurs Multimédia (CPM), a public limited company with a management board, whose registered office is situated at (75009) Paris, 37 rue de Châteaudun, registered with the Paris Trade and Companies Register under number 437 868 425. The TEMIS Register may be consulted by all auction houses operating in France that subscribe to this service. Inclusion in the TEMIS Register may result in restrictions on a bidder’s ability to bid with Professionals subscribed to the TEMIS service.
