SPECIFICATIONS FOR THE SALE BY PUBLIC AUCTION of the IVth CATEGORY LICENCE (public house) N°11543*05 département du 77 Dependent on the judicial liquidation SAS VAP CRETEIL - Trading name : VAPIANO 4th CATEGORY LICENCE N° 13788 Terms and conditions for the sale by public auction of a 4th category licence (for the sale of drinks) formerly operated at 101 avenue Charles de Gaulle in CRETEIL (94000), as part of the judicial liquidation of SAS VAP CRETEIL, under the trade name VAPIANO, declared to be in compulsory liquidation by the Paris Commercial Court in a ruling dated 3 February 2026, with SCP BTSG², Stéphane GORRIAS, residing at 15 rue de l'Hôtel de ville CS 70005 92522 NEUILLY-SUR-SEINE, as its legal representative. We, the undersigned, Maître Olivier LASSERON, Commissaire de Justice à Paris, residing at 46, rue de la Victoire, 75009 PARIS. By virtue of the order issued by the Commissioner of the PARIS Commercial Court, authorising the sale by public auction, We have drawn up the present specifications containing the clauses and conditions in order to proceed with the auction of a licence IV, part of the above-mentioned judicial liquidation. I - DESCRIPTION OF THE OBJECT OF THE SALE The licence IV was part of an establishment operated by Mr Salvatore PERRI in his capacity as Chairman of GIE VAPIANO, manager of SAS VAP CRETEIL, 101 avenue Charles de Gaulle in CRETEIL (94000). The items offered for sale include the licence, which is valid for use and transferable under the conditions of article 47 of law N°2019-1461 of 27 December 2019 and article L3332-11 of the Public Health Code: "A licensed premises for the sale of drinks may be transferred within the department in which it is located. Requests for authorisation to transfer are submitted to the State representative in the department. The mayor of the municipality where the premises are located and the mayor of the municipality to which the premises are being transferred must be consulted. Where a municipality has only one 4th category public house, this public house may only be transferred with the favourable opinion of the mayor of the municipality. "By way of derogation from the first paragraph, an on-trade public house may be transferred to a department bordering the one in which it is located, under the conditions set out in the first paragraph. Requests for authorisation to transfer are submitted to the State representative in the department to which the public house is to be transferred. A public house transferred pursuant to the first sentence of this paragraph may not be transferred to a new département until eight years have elapsed. "By way of derogation from the first paragraph of this article and from article L. 3335-1, on-trade public houses may be transferred beyond the boundaries of the département in which they are located to establishments, particularly tourist establishments, that meet criteria laid down by decree. " The purchaser must complete the following formalities in accordance with the provisions of article L.3332-4 of the Public Health Code: - declaration to the Town Hall, or to the Prefecture of Police for PARIS, 15 days in advance of the transfer-translation of the licence into the new business. - tax declaration of this transfer to the main customs office. II - ORIGIN OF OWNERSHIP : The licence IV was previously operated by Mr Salvatore PERRI in his capacity as Chairman of GIE VAPIANO, manager of SAS VAP CRETEIL, 101 avenue Charles de Gaulle in CRETEIL (94000). III - PRICE : The aforementioned fourth category licence will be put up for sale at a price of ten thousand euros (10,000 euros).
