CONDITIONS OF SALE VILLANFRAY POMMERY AND BARON RIBEYRE & ASSOCIÉS
The sale will be made expressly in cash in Euros.
Purchasers will pay the following costs in addition to the auction price per lot, with no degression:
- 25% excl. VAT, i.e. 30% incl. VAT (or 28.44% excl. VAT for books, i.e. VAT at 5.5%, i.e. 30% incl. VAT);
- 26.5% excl. VAT, i.e. 31.8% incl. VAT for purchases via the Drouot Live platform.
The highest and last bidder will be obliged to pay cash and to provide his name and address. The order of the catalogue will be followed, however the auctioneer reserves the right to combine or divide lots.
Once the auction has been pronounced, the auctioned goods are placed under the entire responsibility of the purchasers. VILLANFRAY POMMERY and BARON RIBEYRE & Associés decline all responsibility for any damage to the item.
VILLANFRAY POMMERY and BARON RIBEYRE & Associés are not responsible for any transport and/or storage.
In accordance with the law, the information given in the catalogue is the responsibility of the auctioneer and the expert, subject to rectifications announced at the time of presentation of the item and recorded in the sale report.
VILLANFRAY POMMERY and BARON RIBEYRE & Associés are operators of voluntary sales of furniture by public auction governed by articles L 312-4 et seq. of the French Commercial Code and the Ministerial Order of 21 February 2012 defining the ethical obligations of operators of voluntary sales.
- Lots 10 to 18, 48 to 55, 97, 116 to 117, 120, 134 to 135, 138 to 139, 141, 145 and 166 are registered in the BARON RIBEYRE & Associés minutes. All other lots are registered in the minutes of VILLANFRAY POMMERY.
- Lot 135 is a temporary import. It is subject to VAT at 5.5% on the total amount (hammer price and buyer's costs).
- Lots 85, 87, 108, 121 to 124, 133, 136 to 137, 140, 142 to 144, 146, 148 to 161, 163, 165, 229 bis, 238 to 263, 266, 268 to 293, 296, and 298 to 303 are sold, exceptionally, by one of our experts, in accordance with Article L321-35 of the French Commercial Code.
PURCHASE ORDER
The auction houses handle the purchase orders entrusted to them free of charge. They must be accompanied by a bank statement or payment card number and proof of identity.
In the event of several bids of equal value, the first bid received shall prevail over the others. However, VILLANFRAY POMMERY or BARON RIBEYRE & Associés shall not be held liable for any error or omission in the execution of these orders.
Any telephone bidding request implies a fixed purchase order at the low estimate plus one bid, in the event that communication is impossible or for any other reason.
In the event of several bids of equal value, the first bid received will prevail over the others.
Telephone conversations may be recorded. In the event of an effective double bid recognised by the auction house, the item will be reoffered for sale, with all bidders able to take part in this second auction.

AFTER SALE
All lots purchased will be taken to the Hôtel Drouot warehouse. The Drouot storage department is open Monday to Friday from 1.30 pm to 6 pm; on Saturdays from 8 am to 10 am when the Hôtel Drouot is open. Additional slots are available by appointment on Tuesdays and Thursdays from 12pm to 1:30pm and from 6pm to 7pm.

Please note that :
- Lots are delivered by Drouot Magasinage after full payment of the sums due, on presentation of the paid slip and the sale label.
- Any item/lot that is not collected within one year of its arrival at the Magasinage department will be deemed to have been abandoned and its ownership transferred to Drouot Enchère as a guarantee to cover storage costs.
VILLANFRAY POMMERY will not be responsible for sending items purchased by clients. It is up to them to make their own arrangements for the collection of their purchase(s). No purchase will be delivered before effective payment of the totality of the slip. The works purchased are under the full responsibility of the buyer as soon as the auction has been announced.
DEFAULT OF PAYMENT
In the event of non-payment, after unsuccessful formal notice, the item may be put back up for sale by irresponsible bidding at the seller's request or at the earliest opportunity.
VILLANFRAY POMMERY and BARON RIBEYRE & Associés reserve the right to exclude from future sales any successful bidder who has defaulted or failed to comply with these conditions.
CONDITION OF THE PROPERTY
Photos are not contractual. Any information relating to an incident, accident, restoration or conservation measure affecting a lot is provided in order to facilitate its inspection by the potential buyer and remains subject to the latter's entire discretion. The absence of any indication relating to an incident, accident, restoration or conservation measure in no way implies that a lot is free of any defect, restoration or conservation measure.
Conversely, a reference to a particular defect does not imply the absence of other defects. No claims will be accepted once the auction has been announced, as the exhibitions will have enabled future buyers to observe the condition of the objects presented and to form their own opinion.
