PESCHETEAU-BADIN, a company specialising in the voluntary sale of furniture at public auction, is governed by the Act of 10 July 2000. ESTIMATES & WARRANTIES The estimates given in the catalogue are for guidance only. Guarantees: Dimensions, weights, colours in reproductions and other information are provided for guidance only. Lots are sold in the condition they are in at the precise moment of their sale, with any defects or imperfections; The absence of any mention of routine restoration, damage, repairs or any other issue in the catalogue, in condition reports or on labels, or during verbal announcements, does not in any way imply that an item is free from defects. As the pre-sale exhibition has enabled prospective buyers to assess the condition of the lots offered for sale, no claims will be accepted once the lot has been sold. For ivory lots, please note that these are specimens compliant with Regulation (EC) No 338/97 of 9 December 1996, Article 2-W, prior to 1 June 1947. For export outside the EU, a CITES export permit will be required; the cost of this will be borne by the future buyer. As dismantling the miniatures can sometimes be delicate, they have been examined visually. THE AUCTION Potential buyers are invited to contact Pescheteau-Badin prior to the sale so that their identity and bank details can be registered. Bidding follows the order of the catalogue. Pescheteau-Badin is free to set the bidding increments, and bidders are required to comply with these. Pescheteau-Badin reserves the right to withdraw, combine or separate lots. The highest and final bidder shall be the successful bidder. In the event of a tie recognised as valid by Pescheteau-Badin, the item will be put up for sale again, and members of the public present may bid. SALES CHARGES: The sale is expressly for cash payment. In addition to the hammer price, buyers shall pay the following fees: 30% inclusive of VAT (25% + 20% VAT) For lots marked with an asterisk*, buyers shall pay, in addition to the hammer price, statutory fees of 14.28% including VAT (11.9% + 20% VAT). A flat rate of 1.5%, or 1.8% including VAT, will be applied to bids placed on DrouotLive. PAYMENT Payment for the lot must be made in cash, covering the full price, fees and taxes, even if an export licence is required. The successful bidder may pay by the following means: - Up to €1,000 for private individuals resident in France and for French, EU or foreign traders. - Up to €15,000 for individuals not resident in France (the nationality stated on a foreign passport alone is not sufficient to determine residence; a certificate of domicile issued by an authority in the buyer’s country is required) - By credit card - By bank transfer to the account: Société Générale, 9 bd des Italiens, 75002 Paris. In the event of non-payment by the successful bidder, following a formal notice that has remained unheeded, the item shall be put up for sale again at the seller’s request on the grounds of a void bid by the defaulting successful bidder; if the seller does not make such a request within one month of the auction, the sale shall be automatically rescinded, without prejudice to any damages owed by the defaulting successful bidder. COMBATING MONEY LAUNDERING AND TERRORIST FINANCING All buyers are required to provide the firm with a copy of a valid ID and proof of address. You may be asked to provide evidence of the origin of the funds used to settle the invoice. DELIVERY OF LOTS Lots will only be released to the buyer upon full payment of the price, fees and taxes. In the meantime, Pescheteau-Badin may charge the buyer storage fees for the lot, and possibly handling and transport costs. STORAGE & SHIPPING After the sale: Upon the award of the lot, the item shall be the sole responsibility of the successful bidder. The buyer shall be responsible for insuring their purchases, as Pescheteau-Badin accepts no liability for any damage the item may sustain, effective from the moment the lot is sold. The export licence procedure may take up to five weeks, although this timeframe may be significantly reduced depending on how promptly the buyer provides their instructions to Pescheteau-Badin. Collection: Following the sale, the furniture, paintings and lots may be collected by the successful bidders in the auction room after payment has been made, until 7 pm or before 10 am the following day; after this time, they will be stored at the Drouot Storage Facility, located on the third basement level of the Auction House. This is a chargeable service, subject to the following conditions: - Administration fee (incl. VAT) per lot: €5 / €10 / €15 / €20 / €25, depending on the nature of the lot* - From the 5th day onwards, storage fees (including VAT) per lot: €1 / €5 / €10 / €15 / €20, depending on the nature of the lot* The administration fee is capped at €50 (incl. VAT) per collection. A 50% reduction on storage fees is granted to overseas customers and art market professionals based outside Paris (upon presentation of proof). Please note that any lot not collected within one year of its arrival at the Storage Department will be deemed abandoned and ownership transferred to Drouot Enchère as security to cover storage costs. In the case of the purchase of small items and subject to Pescheteau-Badin’s agreement, certain lots may be stored free of charge on our premises for 15 days following the sale; after this period, charges may be applied. Shipping of lots: Pescheteau-Badin does not handle shipping. You may, before or after the sale, obtain delivery and shipping quotes for your lots from the carrier of your choice. Drouot has established a partnership with The Packengers, which offers a packaging and shipping service to destinations worldwide. Located in the Client Area on the ground floor of the Hôtel, they arrange for items to be dispatched directly from the auction room. Payment for transport is to be made directly to The Packengers. Purchase orders: Pescheteau-Badin will process, free of charge, any purchase orders and telephone orders entrusted to them and cannot be held liable if the telephone connection is not established, is established late, or in the event of an error or omission.
