GENERAL TERMS AND CONDITIONS: The sale is expressly on a cash-only basis. The items are sold as is; as a pre-sale viewing is held to enable buyers to assess the condition of the items offered for sale, no claims will be accepted once the bid has been accepted. A detailed condition report covering damage and restoration work can be provided on request up to the day before the sale. The successful bidder shall be the highest and final bidder. In addition to the hammer price, they must pay a commission of 30% inclusive of VAT (25% commission plus 20% VAT), including for book sales, which are subject to 5.5% VAT. The information provided in the catalogue is the responsibility of the Auction House, subject to any corrections announced at the time of the item’s presentation and recorded in the sale minutes. Dimensions, weights and estimates are given for guidance only. Re-canvassing, re-stretching or lining are considered to be a conservation measure and not a defect. In the event of a dispute at the time of the auction, i.e. in the event of a tied bid, the lot will be immediately put back up for sale at the price offered by the bidders, and all members of the public will be permitted to bid again. Any consignor who withdraws a consigned item prior to the sale undertakes to bear the costs incurred in connection with that sale, in particular advertising and catalogue costs, and to pay a flat-rate withdrawal fee of 10% (excluding VAT) of the reserve price set for the item in question, or, failing that, its estimated value. TRANSPORT OF LOTS / EXPORT: Once the lot has been awarded, purchases are the sole responsibility of the successful bidder; the Auction House accepts no liability for the storage or transport of the lot. Lots will be stored at the Drouot warehouse at the purchasers’ expense. Coutau Bégarie will not arrange for the dispatch of any lots. Storage charges will be levied on a pro rata basis according to the space occupied if the lots are not collected promptly after the sale. PAYMENT / FAILURE TO PAY: No lot will be handed over to the successful bidder until all sums due have been paid in full. In the event of payment by cheque, transfer of ownership of the lot will only take place once the cheque has cleared. Payment by a cheque without sufficient funds or failure to pay shall not render the Auction House liable and shall consequently release it from any obligation to pay the seller. In the event of non-payment, the lot may be put up for auction again as a ‘folle enchère’. The sale will be conducted in euros. Payment for lots, as well as any applicable taxes, must be made in the same currency. Cash payments are limited, including taxes and fees, to €1,000 for French nationals and €15,000 for foreign nationals, subject to proof of identity (Decree No. 2015-741 of 24 June 2015). Cheques drawn on a foreign bank will only be accepted with the prior consent of the Auction House. To this end, buyers are advised to obtain, prior to the sale, a letter of credit from their bank for an amount approximating their intended purchase, which they must then forward to the Auction House. In the event of non-payment of the hammer price and fees, a formal notice will be sent to the buyer by registered post with acknowledgement of receipt, at the buyer’s expense. Upon expiry of a one-month period following this formal notice, and in the event of non-payment of the sum due, an additional fee of 10 per cent of the hammer price, subject to a minimum of 250 euros, shall be charged to the purchaser to cover recovery costs. The application of this provision does not preclude the award of damages and costs of any necessary legal proceedings, nor does it prejudice the possible initiation of proceedings relating to a frivolous bid. For lots subject to temporary importation, a tax of 5.5 per cent shall be payable by the buyer. Any bank charges incurred as a result of payment from abroad, by cheque, credit card or bank transfer, shall be borne by the buyer. PURCHASE ORDERS: The Auction House and the Auctioneer may execute any purchase order at no additional cost; requests must be made in writing, 24 hours before the auction, using the form included in this catalogue, duly completed and accompanied by a cheque or bank details. The Auction House will act on behalf of the bidder in accordance with the instructions contained in the purchase order form, with the aim of purchasing the lot(s) at the lowest possible price and under no circumstances exceeding the maximum amount specified by the bidder. Telephone bidding: Buyers wishing to be contacted during the sale must use the form in accordance with the conditions set out above. Purchase orders are a service provided for the convenience of clients. The Auction House shall not be held liable for failing to execute an order due to error or for any other reason. Bulky lots acquired via a purchase order will be stored at the Drouot warehouse (see applicable terms and conditions). Smaller lots will be held at the auction house; after one week, a flat-rate charge of €3 per day will apply. Purchases via the Drouot Live platform: For all purchases via Drouot Live, an additional fee of 1.5% excluding VAT will be applied (i.e. 1.8% including VAT). Purchases via the Drouot Online and Interenchères platforms: For all purchases made via these platforms, an additional charge of 3% excluding VAT will be applied (i.e. 3.6% including VAT).
