Terms and conditions of sale
Daguerre, whose registered office is at 5bis rue du Cirque - 75008 Paris, is an operator of voluntary sales of furniture by public auction governed by articles L. 321-4 et seq. of the French Commercial Code (VEP).
In this capacity, Maison Daguerre acts as an agent on behalf of the seller and is therefore in no way a party to the sales contract.

General terms and conditions
These general terms and conditions apply unreservedly to buyers. They are communicated prior to auction sales on our website.
By placing a bid, the bidder acknowledges having read the general terms and conditions and accepts them unreservedly.
Please note that the terms and conditions may be subject to any written or oral amendments made before and during the sale, which will be recorded in the sale minutes.
BEFORE THE SALE
Information about the lots
The information notes relating to the lots contained in the catalogues are drawn up according to the state of knowledge on the day of the sale and with all due diligence, subject to possible corrections announced verbally at the time of presentation of the lot and recorded in the sale report.
Condition of lots
Lots are sold as is; it is therefore the responsibility of the bidders to examine each lot during the exhibitions. The absence of any mention in the catalogue in no way implies that the lots are in perfect condition or free from damage or accidents. Only the existence of significant restorations, missing items or additions should be indicated. The dimensions and weights of lots are given for information only.
Photographs of lots
The photographs are provided for information purposes only and do not necessarily provide exhaustive information on the condition of the lots.
Changes to information
The information in the catalogue may be subject to correction up to the time of the sale. These changes are made known to the public by an announcement made by the authorised auctioneer and are recorded in the minutes of the sale.
Lot estimates
The auction house specifies that estimates are based on the condition, rarity, quality and provenance of the lots, as well as on recent auction prices for similar items. Estimates are subject to change and do not constitute any guarantee to the seller.
Withdrawal of a lot before or during the sale
Daguerre reserves the right to withdraw a lot before or during the auction. This withdrawal in no way engages the responsibility of the auction house towards the bidders.
SALE
Conditions of access to the sale
Registration of potential bidders :
Bidders are invited to register in advance with the auction house by providing proof of identity, bank details and references.
Right of access :
Daguerre reserves the right to deny access to the sale to any bidder for just cause (TEMIS registration or other).
Security deposit :
Daguerre reserves the right to request a security deposit which will be returned after the sale if the bidder does not win the lot. Please note that the return of funds may take up to 10 days / 15 days for foreign banks.
Auction procedures
Purchase orders and telephone auctions
Daguerre executes firm purchase orders and telephone bids free of charge, according to the bidder's instructions. The bidder sends his request by e-mail to
[email protected] or by means of a paper form.
For all requests, please enclose proof of identity (natural person) or a Kbis extract (legal entity), your postal and telephone details and an e-mail address.
As a reminder, a deposit may be required before a purchase order or telephone bid can be taken into account.
Online sales
Users may take part in an online auction via the DROUOT platform and must read and accept, without reservation, the terms and conditions of use, which are in addition to the general terms and conditions of Maison Daguerre.
To bid online, please use the Drouot platform as a priority.
The course of the sale
Discretionary power of the auctioneer
The authorised auctioneer organises and directs the bidding at his own discretion. The auctioneer's conduct of the sale follows the order of the catalogue numbering and the bidding levels are at his discretion. The authorised auctioneer ensures that bidding is free and that all bidders are equal. He has the right to refuse any bid, to withdraw a lot from the sale and to designate the winning bidder, i.e. the highest bidder and the last bidder, once the term "awarded" has been pronounced. Under no circumstances may the auction house be held liable for the aforementioned reasons.
Exercise of the right of pre-emption
In accordance with articles L. 123-1 and L. 123-2 of the French Heritage Code, the State or the BNF may exercise a right of pre-emption, i.e. replace the last bidder, on works of art offered by VEP or at a private treaty sale. In this sense, the company cannot assume any responsibility for the administrative decisions of the State.
The after sale
Lots not sold at the end of a VEP may be the subject of a private treaty sale, known as an "after sale", for which the present terms and conditions also apply.
